SCOPE


DAM Desarrollo en Automatización y Movimiento, hereinafter referred to as (DAM Automatización), issues this PRIVACY NOTICE, prepared in compliance with the FEDERAL LAW FOR THE PROTECTION OF PERSONAL DATA HELD BY PRIVATE PARTIES (LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE LOS PARTICULARES), whose purpose is to inform you about the type of personal data we collect from you, how we use, manage, and process it, and with whom we share it.

This Privacy Notice is applicable to all collaborators of DAM Automatización, internal and/or external, clients and/or suppliers of any type of service, as well as any individual or legal entity that establishes or intends to establish a legal or business relationship with DAM Automatización.


DATA CONTROLLER (RESPONSABLE)


For the purposes of this Privacy Notice, the Data Controller responsible for the collection, disclosure, storage, use—including access, handling, processing, transfer, or disposal—of personal data is the Legal Representative of DAM Automatización.

INFORMATION TO BE COLLECTED AND ITS PURPOSE


The information that the designated personnel of DAM Automatización may collect will be obtained through different sources, including:

  • Direct: When you provide us with your personal data to carry out any procedure required by DAM Automatización, whether in person, electronically, or otherwise.

  • Indirect: From any other source of information permitted by Law.

Below are examples of the personal data requested: identification data (name, gender, address, postal address, contact phone numbers (home, office, and cell), age, date of birth, marital status, nationality, country of birth, Unique Population Registry Code [CURP], Social Security Number, Federal Taxpayer Registry [RFC], official identification number or folio), labor data (occupation, personal references, email address, names of previously employed companies, position, length of service at those companies, other sources of income), family data (economic dependents, spouse and children data, and family members), academic data (education level, educational history, title, professional license number, certificates), among others.


PURPOSES OF PERSONAL DATA PROCESSING


The processing of the data subject's personal data, including sensitive personal data that we may collect, and unless the data subject decides otherwise through the process described in this Privacy Notice, has the following purposes, among others:

  • Contracting purposes.

  • Legal procedures, attention to requirements from competent authorities.

  • Inclusion in a database for payroll management, permits, procedures, statistics, evaluation, personnel development, etc., all related to the personnel administration process, based on duly formalized procedures, instructions, or manuals, in accordance with the policies of DAM Automatización.

  • In the case of suppliers and clients, the purpose is inclusion in a database for financial, sales, distribution, and purchasing procedures such as collections, payments, as well as to provide the required services and products and related activities, among others.


OPTIONS AND MEANS OFFERED BY DAM AUTOMATIZACIÓN TO DATA SUBJECTS TO LIMIT THE USE OR DISCLOSURE OF THEIR INFORMATION


The data subject's personal data will be kept in strict confidentiality, in accordance with the administrative, technical, and physical security measures that DAM Automatización implements or has implemented in its policies and procedures to protect personal information against loss, misuse, or alteration, with its illicit disclosure prohibited and its use limited to third parties, as provided in this Privacy Notice.

DAM Automatización guarantees the security of data transferred to third parties, demanding a privacy notice from each of them. This applies in cases where, due to regulatory issues, services are required such as: Clinical and Cabinet Laboratories, Law Firms, Accounting Firms, Banking Institutions, etc., who must observe the same guarantees of handling and confidentiality offered by DAM Automatización.


MEANS FOR THE EXERCISE OF ARCO RIGHTS BY THE DATA SUBJECT


The data subject may, at any time, exercise their rights of access, rectification, cancellation, opposition (ARCO rights), limitation of use, disclosure, or revocation, when they consider that the personal data is excessive or unnecessary for the purposes that justified its collection, or to oppose the processing of the data for specific purposes, according to the following:

Mechanism by which the data subject can revoke their consent to the processing of their personal data or request its rectification. To request the revocation of consent to the processing of personal data, the data subject or legal representative may go to the Administrative Department of DAM Automatización with a written request that must contain the following:

  1. The full name of the data subject, address, and email account, in order to communicate the response to their request.

  2. The documents that prove the identity and, where applicable, the legal representation of the data subject.

  3. A clear and precise description of the personal data regarding which any of the aforementioned rights is sought to be exercised.

  4. Any other element or document that facilitates the location of the personal data.

In the case of requests for rectification of personal data, the data subject must indicate the modifications to be made and provide the documentation supporting their request. The Data Controller will issue the response to the data subject's request within a period not exceeding 25 days, counted from the date the request for access, rectification, cancellation, or opposition was received, via a written document sent by email or delivered in person to the applicant, and subsequently and immediately, inform those designated as data processors about the revocation of consent. The data subject will have access to the collected personal data, upon express request, in a document that must contain the data they require to be displayed and the reason why said access is requested from the personnel responsible for handling personal data.


TRANSFER OF PERSONAL DATA


DAM Automatización may perform the transfer and processing of personal data within and outside the country to:

  • Third parties resulting from a corporate restructuring, including merger, consolidation, sale, liquidation, or transfer. The third parties and the receiving entities of personal data assume the same obligations and/or responsibilities as DAM Automatización, in accordance with the description in this Privacy Notice.

The data subject who submits any request to establish a legal relationship with DAM Automatización accepts the transfer of their personal data, under the terms described in this Privacy Notice. If you do not express your opposition to the transfer of your personal data, it will be understood that you have granted your consent for it.

We commit not to transfer your personal information to third parties without your consent, except for the exceptions provided in Article 37 of the Federal Law for the Protection of Personal Data Held by Private Parties, as well as to carry out this transfer in the terms established by said law.


CHANGES TO THE PRIVACY NOTICE


We reserve the right to make modifications or updates to this privacy notice at any time, for the attention of legislative or jurisprudential developments, internal policies, new requirements for the provision or offering of our services or products, and market practices. Any change to this privacy notice will be informed to you through any of the following means:

  • Notices on informational boards placed at DAM Automatización.

  • Email.

  • Notices on the DAM Automatización portal.

  • Written notifications of changes.
