Terms and Conditions of Sale and Warranty

1. Object and Scope

These Terms and Conditions regulate the sale of Industrial Automation equipment and components (hereinafter, the "Equipment") by DAM Desarrollo en Automatización y Movimiento (hereinafter, "DAM") to its clients (hereinafter, the "Buyer"). The acceptance of the quote and/or the issuance of the purchase invoice for the Equipment implies the full and unreserved acceptance of these terms.

2. Warranty Policy

2.1 Warranty Period

  • DAM warrants the Equipment for a period of one (1) year (12 months), starting from the invoice date, against manufacturing defects and/or materials, under normal and proper conditions of use, installation, and maintenance.

  • This warranty is limited to the repair or replacement (at DAM's or the manufacturer's discretion) of the Equipment that presents covered failures.

2.2 Warranty Exclusions

The warranty will be voided and shall not apply in the following cases:

  • Damage caused by misuse, abuse, negligence, incorrect installation, improper storage, or lack of maintenance in accordance with the manufacturer's specifications.

  • Failures originating from external factors such as electrical overloads, voltage fluctuations, atmospheric discharges, humidity, fire, accidents, natural disasters, or any force majeure event.

  • Tampering, repair, or modification of the Equipment by personnel not authorized by DAM.

  • When the Equipment’s serial number has been altered, erased, or removed.

  • Natural wear and tear of components from normal use.

2.3 Procedure for Claiming Warranty

  1. The Buyer must notify DAM in writing about the detected defect within the warranty period, attaching the purchase invoice and a detailed description of the problem.

  2. The Equipment must be returned to DAM's facilities (or the designated location) for technical inspection. Initial shipping costs for the review will be the responsibility of the Buyer.

  3. Mandatory Condition: For the warranty to be processed, it is essential that the Buyer retains and returns the Equipment in its complete original packaging. The absence of the original packaging may be grounds for the cancellation of the warranty, as the packaging is crucial to ensure correct handling and protect the integrity of the equipment during transport and evaluation.

  4. DAM or the manufacturer will evaluate the warranty claim’s eligibility. The estimated response time will be informed to the Buyer.

  5. If the warranty is eligible, DAM will cover the costs of repair or replacement and the return shipping cost to the Buyer. If it is not eligible, the Buyer will be notified of the repair cost or the return of the equipment at the Buyer's expense.

3. Limitation of Liability

  • DAM's sole liability under this warranty is expressly limited to the repair or replacement of the defective Equipment.

  • DAM shall not be liable for losses, damages, indirect, consequential, or any other type of damages (including, but not limited to, loss of production, loss of profit, or plant shutdown costs) arising from the use or inability to use the Equipment, even if the defect is covered by the warranty.
